The entire subject of Patents become somewhat cloudy when dealing with public colleges. If Public funds finance the research, then the public owns the results of the research, i.e., they are in the public domain. By law, theroretically, a US patent cannot be issued to anything that the taxpayers paid to produce.

this is probably a topic for a different thread, but federal and state institutions issue patents all the time, regardless of funding source. Although their motivation for protecting intellectual property may be somewhat different than for private companies, they have been assertive at protecting novel discoveries/inventions. As Carol mentions, IP licensing is an important source of revenue for many universities.

Politics is a forbidden subject here on this forum, but this goes beyond political, into legal. As a tax payer, I own a percentage of each patent of every patent ever issued to any university that was derived by the use of public funds. As a partial owner of those patents, I certainly have a right to use that product for my own personal use without having to pay any royalty to anybody....My opinion...take me to court if you do not agree.
It gets iffy if I were to make a profit from that usage...but I still own a percentage of that patent!!. |

I personally do not find any good reasons why intellectual
property developed at taxpayer expense should become an asset of a private company that the same taxpayer's that funded its development have to pay that company to use. Where Bayh-Dole got really juicy for the private sector was when the practice was extended by the Reagan administration to *any* technology developed with public funds, by any company, not just universities, non-profits, and small business, by administrative fiat: http://www.constructionweblinks.com/...2005/stri.html (This is getting well beyond the seed question, but the Wikipedia explanation of the impact of Bayh-Dole seemed incomplete without it. Calls for revolution in response should perhaps be posted to a different forum.)

I read drug companies get up to 85% of their money for research from the taxpayer. There definitely is a need for reform.

I strongly believe that if/when Bayh-Dole gets challenged @ the US Supreme Court level, it (the law) will be overturned. The law violates our constitution, and Congress does not have the right to create such a law, IMHO
