nicking photos to sell on ebay.
This is an obvious follow on from the dr tomato thread where someone used photos nicked from various places on the web to sell their own product. I would like to get folks to take a look at Ebay and see if their photos are being used inappropriately.
Here is one example of an inappropriate use of one of my photos. http://cgi.ebay.com/ws/eBayISAPI.dll...m=300405957717 And here is my original photo from my website. DarJones |

If you do find any of yours, send the seller an email, AND be certain to CC e-bay as well. E-bay will make sure that pirated photos get removed, as well as sending strong warnings to the abusers.

I found a complete site in Pakistan who had stolen all my pictures, set up a site selling the same items. The idiot then sent a message asking if I wanted to buy from him. Stupid clown!!
He refused to remove the pictures, until I had a number of friends bombard his e mail with hundreds of pictures. He quickly cried 'Uncle' and removed them. Sometimes you have to take the law into your own hands. |

Yes eBay is generally quite good at taking down pirated pics or listings IF they are reported to them. You may have to jump thru a few hoops to PROVE that the pics are yours, but please do it.
The person using the pics will be warned or worse. If they have a history of abuses, they will possibly get suspended or even totally thrown off eBay. Considering the many other problems eBay has, they generally do that right. Carol |

ebay has too much to lose to allow a few vendors to bring trouble to their business. They would much prefer to count their commissions, than to have to get their lawyers involved with a wayward vendor.
I would be naive to think that their entire site was totally 'above board', but they take great efforts striving to keep it a site where buyers can go and be assured a clean/safe transaction. I cannot even imagine the infrastructure they have in place to keep it so. They WILL investigate any suggestion of wrong-doing. |

Sometimes I am amazed at the places my photos show up. Today, I found one on Tatianas site. Before you go off at the wrong angle, I have absolutely no problem with my photos being used at Tatiana's. I was just surprised to find one of them showing up there.
http://tatianastomatobase.com/wiki/F...e_potatoes.JPG I posted this photo in the potato forum on t'ville a couple of years ago. I'm pretty sure that Tom Wagner uploaded it to tatiana's site. My only complaint is that it could use a caption something like: "Potatoes by Tom Wagner, photo by Darrel Jones" DarJones |

This photo was sent to me by Tom Wagner via email with the purpose to upload on his member page at TOMATObase. I had no idea this was your picture! I will contact Tom and and ask him what he wants me to do with this picture. In a meanwhile I will remove it from the member page. Tania

It sounds as though Darrel has no problem with it being on your site, Tania. Especially as it isn't being used to sell potatoes. I think he was just making an observation, is all.

Mischka,
I need an explicit permission from the picture owner to upload a picture (or keep a picture, in this particular case) at TOMATObase. Otherwise, technically, it is a copyright violation on my part and a violation of TOMATObase's terms and conditions. Tania

Tania,
You have my explicit permission. That is a wonderful photo that shows off some of Tom's better varieties. I also know that you are not using it for any exploitative purpose. Just for reference, here are the original two photos. You are welcome to use both of them if you choose. http://www.selectedplants.com/garden...tatoes_002.jpg http://www.selectedplants.com/garden...tatoes_003.jpg As an interesting aside, all of the potatoes in the photo are interesting, but the most interesting one of all for me is Azul Toro. It is the most productive dark blue/purple potato I've ever grown. It makes about 5 pounds of spuds per plant! That is higher than most commercial potatoes I've ever grown. Thanks, Darrel Jones p.s. I like playing word games, this for folks who spot the alliteration above. Last edited by Fusion_power; October 9, 2010 at 07:35 PM. Reason: add links |

I am not a big potato person, as they have not done well for me in the past, but I grew sweet potaotes this year and they produced like mad. several huge ones! prolly due to the hot hot summer. Now I'm thinking I should give potatoes another try. |

Thank you so much for the permission! It is a great photo of Tom's potatoes indeed, with so many most unusual potato varieties. I will link it back, and I will also indicate that this is your photo. Thank you Tania
