Default Tomatoville logo copyrighted?

Just randomly saw this when researching local produce distributors. It is almost exactly the same as the Tomatoville logo. They just added a backround and framed it. What an odd coincidence.

I noticed, and was chatting to MissS about it, right after BVV posted. The semi tractor has exactly the same tomato head but the trailers have the tomato head with a dark shirt.

Wonder how many trucks and trailers there are and if the logo has been printed on boxes, etc., - thinking of the cost to remove/replace all that.

The blog is way out of date, oddly.

Copyright protection is regional, unless Federally registered. Protection comes from use of the mark. The standard is consumer confusion. One would have to make the claim that the produce company was making people think they were affiliated with tomatoville, or vice-versa.

Even with no legal recourse I'd still inform them it's not their art, concept, or property and they're using it for gain without permission.
